Terms of Service

These Terms of Service ("Terms") govern your access to and use of EarningsCalls.ai (the "Service"), a website that lets you search and ask natural-language questions about publicly available company earnings call transcripts. By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service uses automated retrieval and AI language models to surface and summarise passages from public earnings call transcripts. Responses are generated by AI and may be incomplete, outdated, or inaccurate. The Service is offered on a tiered basis (Guest, Free, Basic, and Pro), each with different limits and features as described on our pricing page.

2. Not investment advice

The Service is provided for general informational and educational purposes only. Nothing produced by the Service constitutes, and it must not be relied upon as, investment, financial, legal, tax, or other professional advice, nor a recommendation, offer, or solicitation to buy, sell, or hold any security or financial instrument.

• AI-generated answers may contain errors, omissions, or misattributed statements.
• Past performance and management commentary are not indicative of future results.
• You are solely responsible for your own investment decisions and any resulting outcomes.
• You should independently verify information and consult a licensed financial professional before acting.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to accuracy, completeness, merchantability, or fitness for a particular purpose, to the fullest extent permitted by law.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. Authenticated access uses passwordless ("magic link") sign-in tied to your email address. You are responsible for keeping access to your email and account secure and for all activity under your account. Provide accurate information and keep it up to date.

4. Subscriptions, billing, and cancellation

Paid tiers (Basic and Pro) are billed through our payment processor, Stripe. By subscribing you authorise recurring charges for the plan you select until you cancel. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you retain paid access until then. Except where required by applicable law, payments already made are non-refundable. We may change prices or plan features on a prospective basis with notice.

5. Acceptable use

You agree not to:

• Scrape, harvest, resell, or bulk-export content, or use the Service to build a competing dataset or model;
• Circumvent or exceed rate limits, tier restrictions, or access controls;
• Submit prompt-injection, jailbreak, or other attempts to manipulate the AI or extract restricted data;
• Reverse engineer, probe, or disrupt the Service or its infrastructure;
• Use the Service for any unlawful purpose or in violation of these Terms.

We may suspend or terminate access for conduct that violates these Terms.

6. Intellectual property

The Service's software, design, and branding are owned by the operator of EarningsCalls.ai. Underlying transcript text is sourced from third parties and reflects public company disclosures; rights in that source material remain with their respective owners. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own personal or internal business purposes, subject to these Terms.

7. Third-party data and no affiliation

Transcript data is obtained from third-party providers and may itself contain errors. We are not affiliated with, endorsed by, or sponsored by any company whose earnings calls are referenced. Company names and tickers are used only to identify publicly available material.

8. Limitation of liability

To the fullest extent permitted by applicable law, EarningsCalls.ai and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, trading or investment losses, or loss of data, arising out of or related to your use of (or inability to use) the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Spanish or EU law.

9. Indemnity

You agree to indemnify and hold harmless EarningsCalls.ai and its operator from any claims, losses, or expenses arising from your use of the Service or your breach of these Terms, to the extent permitted by applicable law.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law and contact

These Terms are governed by the laws of Spain and the European Union, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence are unaffected. Questions about these Terms can be sent to info@earningscalls.ai.
